泰领翻译个人抵押贷款合同翻译难点点睛系列之一：

关于孳息 从物 从权利 附属物 添附物 附合物 混合物等术语的翻译

 

国内各大银行都有自己的个人住房抵押贷款合同标准版，这些抵押贷款合同根据国家有关法律的要求，所包括的主要条款具有一定的相似性，但由于众所周知的银行贷款业务的复杂性，每家银行的贷款合同有关借款利率、放款、抵押物、担保、保证、抵押、质押、保险、还款等等的条款纷繁复杂，花样百出，加之用词各异甚至不规范，给翻译带来无穷的困扰。鉴于此种情况，我们决定不定期发布一些小文章探讨这类文件的翻译，期待更多同行的关注，也希望能够给有关译员提供一些帮助。

 

例1 广发银行质押条款中关于质押财产有如下规定：

…… 本合同项下的质权及于《质押财产清单》所列质押财产的孳息、从物、从权利、附属物、添附物、附合物、混合物、加工物及质押财产的代位物。

Google翻译如下： Under this contract, the right quality and the pledge of property listed in the list of the pledge yield from the material from the right, appendages appended material, attached complexes, a mixture of the workpiece and the pledge of property subrogation matter.

有翻译人员翻译如下：

The right of pledge hereunder and the interest thereon, accessory thing, secondary right, accessory, accession thing, thing connected, thing mixed, processing thing and subrogation thing of the Pledged Property stated in the List of Pledged Property.

译员对其中的有关术语的理解和翻译存在这明显的困难和错误：

孳息、从物、从权利、附属物、添附物、附合物、混合物

被翻译成：

accessory thing, secondary right, accessory, accession thing, thing connected, thing mixed

可以看出，译员也在网上和词典中努力搜寻过，但结果肯定不会令人满意，甚至根本就没有相对应的翻译。

此外，上述译文也不符合法律语言严肃认真的基本要求。

作为法律翻译的译审人员，我们的做法是：首先解决对原文中这些术语的专业概念的理解，然后再去英美法、其他有关资料并结合自己的法律英语专业知识，最后提出如下翻译建议：

孳息 yield/proceeds on the pledged property

从物incremental accessories

从权利secondary rights

附属物fixtures

添附物accretions

附合物annexures

混合物admixtures

 

最后修改如下：

The rights under the pledge shall include the yield on the Pledged Property, the incremental accessories, secondary rights, fixtures, accretions, annexures, admixtures, processed goods, and subrogation thereto or therewith stated in the List of Pledged Property.

 

另外，请注意此处“及于”的理解与翻译。此处，我们把它翻译为include。这个词语在翻译中经常会被误解为“and”!请注意哦： “及于” in 本合同项下的质权“及于”《质押财产清单》所列质押财产的孳息 ... means 因为某物或某人的关系对于与他相关的事物或人有联系或起作用，也有“包括”的意思。
